These Terms and Conditions govern access to and use of the website, platform, pilot programs, integrations, and other services provided by Saint Jude Project Intelligence, operated by Erik Scaranello Ltda.
By creating an account, accessing or using the platform, enabling an integration, participating in a pilot program, or accepting these Terms through a button, checkbox, or similar mechanism, you confirm that you have read, understood, and agreed to these Terms.
If you do not agree to these Terms or cannot comply with the obligations described in them, you must not access or use the platform or connect systems or data to Saint Jude.
When Saint Jude is used through an organization, these Terms also apply to use by that organization's authorized users, without limiting any commercial agreements, orders, proposals, data processing agreements, or other specific instruments entered into between Saint Jude and the customer.
If you create an account, access, purchase, use, or configure Saint Jude on behalf of a company, employer, or other organization, you represent and warrant that you have sufficient authority and authorization to act on behalf of that organization and, where applicable, to bind it to these Terms.
If you do not have authority to act on behalf of the organization or are not authorized to use Saint Jude for business purposes, you must not represent yourself as acting for the organization, purchase services on its behalf, or connect systems, credentials, data, or resources belonging to that organization.
Having technical access to a particular account, project, system, API, token, credential, or dataset does not, by itself, mean that you are authorized by the organization to provide that information to third-party services. You are responsible for complying with your organization's internal policies, contractual obligations, confidentiality obligations, and other applicable requirements.
You must provide accurate, complete, and current information when creating or managing an account and are responsible for activities performed through your credentials.
Passwords, tokens, API keys, and other credentials must be kept secure and must not be shared with unauthorized persons. If you suspect that credentials have been compromised, improperly accessed, or used without authorization, you must revoke or replace the affected credentials and notify Saint Jude when appropriate.
Saint Jude may provide integrations with third-party platforms, including Jira, Azure DevOps, ClickUp, monday.com, Asana, and other services made available or supported over time.
By enabling an integration, providing a token, key, credential, or granting any other form of access, you represent and warrant that you have all rights, permissions, and authorizations necessary to establish that connection and to allow Saint Jude to access and process the data made available through the integration.
You also represent that you have an appropriate legal basis and authorization to make available to Saint Jude data relating to the organization, its projects, customers, teams, employees, contractors, or other users, and that the integration complies with applicable internal policies, contracts, confidentiality obligations, and laws.
If you do not have the required authorizations, you must not connect the integration. Saint Jude may restrict, suspend, or remove an integration when it identifies a security risk, unauthorized use, a violation of these Terms, or when necessary to comply with a legal obligation or a legitimate request from the customer responsible for the data.
The organization and its users remain responsible for the data, information, and materials made available to Saint Jude through the platform or integrations. Saint Jude does not acquire ownership of the customer's business data as a result of processing it.
You represent and warrant that you have the rights, authorizations, permissions, and, where applicable, consents necessary to provide such data to Saint Jude and allow its processing for purposes related to providing the services.
The customer is responsible for the accuracy, quality, legality, and appropriateness of the data provided, as well as for determining which users and systems may access or share that information.
Use of Jira, Azure DevOps, ClickUp, monday.com, Asana, or any other third-party service remains subject to the terms, policies, and configurations of the applicable provider.
Saint Jude does not control the availability, APIs, permissions, or changes made by those providers and cannot guarantee that a particular integration will remain available or operate without interruption when changes occur outside Saint Jude's control.
You must not use Saint Jude to:
Saint Jude may use artificial intelligence, statistical models, automated rules, and other analytical techniques to organize data, identify patterns, generate indicators, anticipate risks, and provide recommendations related to project management.
These analyses are decision-support tools and do not replace professional judgment or the context of the organization. The user and customer remain responsible for decisions made based on information provided by the platform, particularly decisions that may have legal, financial, disciplinary, or other significant effects on individuals.

When Saint Jude acts as an operator or data processor on behalf of a business customer, processing will be performed in accordance with the customer's documented instructions, applicable contractual instruments, and relevant data protection laws, including Brazil's LGPD and the GDPR where applicable.
Saint Jude and its licensors retain all rights relating to the platform, software, interfaces, models, methodologies, trademarks, documentation, and other proprietary elements of the service, unless expressly stated otherwise.
Comments, suggestions, and feedback voluntarily provided regarding the product may be used by Saint Jude to develop, improve, and enhance its services, without transferring ownership of the customer's business data.
Saint Jude may add, modify, replace, or discontinue features in order to evolve the platform, correct issues, comply with technical or legal requirements, and improve security or the user experience.
Pilot programs, trial versions, experimental features, or resources under development may have limitations, changes, or periods of unavailability and do not constitute a guarantee of future availability or a final commercial engagement.
Saint Jude may limit, suspend, or terminate access to the platform or certain integrations in the event of a violation of these Terms, a security risk, fraudulent or unauthorized use, a legal obligation, a valid request from the organization responsible for the account, or a material risk to Saint Jude, its customers, or third parties.
Pricing, trial periods, pilot programs, usage limits, payment terms, renewals, and other commercial terms may be established through an ordering page, proposal, order, agreement, or other specific instrument. If there is a conflict regarding a specific commercial matter, the specific instrument entered into between the parties will control.
Saint Jude seeks to provide useful and reliable analyses but does not guarantee that forecasts, recommendations, risk classifications, or other analytical results will be complete, error-free, or capable of anticipating every event that may affect a project.
To the maximum extent permitted by applicable law, and except for liabilities that cannot legally be excluded or limited, Saint Jude will not be liable for indirect or consequential damages, lost profits, or losses resulting from decisions made solely on the basis of platform analyses, unauthorized use of data or credentials by the user, or failures and changes involving third-party services.
Applications to the Saint Jude Partner Program are used to evaluate companies interested in working commercially with Saint Jude. Submitting an application does not guarantee acceptance and does not, by itself, create a partnership, representative, agency, exclusive, or other commercial relationship or obligation.
By submitting an application on behalf of an organization, you represent that the information provided is accurate and that you are authorized to provide it and initiate discussions regarding a potential partnership.
If an application is accepted, additional terms may be established to govern referrals, opportunities, commissions, trademark use, responsibilities, confidentiality, and other aspects of the program. Partners must not use deceptive, fraudulent, abusive, or unauthorized practices.
These Terms may be updated to reflect changes to the platform, services, applicable laws, or Saint Jude's business practices. When a change is material and applies to existing users, we may use reasonable means to communicate it. The current version will always be available on this page.
These Terms will be interpreted in accordance with the laws of the Federative Republic of Brazil, without limiting the application of mandatory laws of other jurisdictions where legally required. Where permitted by applicable law, the courts located in Curitiba, Paraná, Brazil will have jurisdiction over disputes relating to these Terms.
